Terms of Use

1. Eligibility and Agreement

You must be at least 13 years old, or the higher minimum age required in your country, to use Neyli. If you have not reached the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you.

You represent that you are legally permitted to use Neyli and are not barred from receiving services under applicable law. You may use Neyli only in compliance with these Terms, the Privacy Policy, Apple Media Services terms, and applicable law.

2. Account and Security

Neyli may offer Quick Login, Sign in with Apple, and Google sign-in. You must provide accurate profile information, use only an account you are authorized to use, and protect access to your device and sign-in provider.

You are responsible for activity associated with your Neyli identity. Notify Neyli Team at neyliteam@outlook.com if you believe an account or purchase record has been used without authorization. Neyli Team may request reasonable information to verify an account, support request, rights notice, or safety report.

3. Application License

Subject to these Terms, Neyli Team grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use Neyli on Apple-branded products that you own or control, as permitted by the Apple Media Services Usage Rules. Family Sharing or volume-purchase access may apply when permitted by Apple.

For an App Store download, the Apple Standard End User License Agreement applies to the application license and these Terms supplement it. If these Terms conflict with a mandatory Apple license provision, that Apple provision controls to the extent of the conflict.

You may not copy, modify, distribute, sell, lease, reverse engineer, bypass access controls, interfere with security, extract source code except where such restriction is prohibited by law, or use Neyli to create an unlawful or infringing service.

4. Neyli Features

Neyli provides wallpaper discovery and download tools, mood entries, creative canvases, media capture and selection, audio layers, archives, remixes, creator interactions, safety controls, and related profile features. Feature availability may depend on your device, iOS version, permissions, App Store status, content rights, and account state.

You control whether to grant camera, photo, or microphone permission. You are responsible for reviewing any generated, edited, downloaded, exported, or shared result before using or distributing it.

5. Glow and In-App Purchases

Glow is a digital unit used only within Neyli to access eligible content and features. The available Glow products, amounts, and any applicable usage requirements are shown in Neyli and may change as the service evolves.

Glow products are consumable in-app purchases processed by Apple. The product details, price, currency, taxes, and terms shown in Neyli and on the App Store purchase confirmation at the time of purchase govern the transaction and may differ by storefront. Apple handles billing credentials. Neyli records the product identifier, transaction identifier, delivered Glow, displayed price, and delivery status to prevent duplicate credit.

Glow has no cash value, cannot be transferred, sold, redeemed for money, or used outside Neyli, and does not create a property interest. Consumable Glow is not restored automatically. Except where law requires otherwise, refund requests and billing issues are handled by Apple under Apple's refund rules. If Apple reverses a transaction, Neyli may correct the related Glow balance or purchase record.

Neyli will not intentionally charge you without the App Store purchase confirmation. If a transaction cannot be verified, Glow will not be delivered. You must not manipulate receipts, transaction identifiers, product availability, balances, or signed-wallpaper access.

6. User Content

“User Content” includes profile text, avatars, mood notes, photos, camera captures, audio recordings, comments, reports, canvases, remixes, and other material you select, create, import, submit, export, or share through Neyli.

You retain ownership of your User Content. You grant Neyli Team a worldwide, non-exclusive, royalty-free license to host, process, reproduce, adapt, display, and transmit User Content only as needed to operate Neyli, provide requested features, maintain safety, respond to support, and comply with law. This license ends when the content is deleted, except for copies already shared at your direction, records required for safety or legal compliance, and reasonable technical retention.

You represent that you own or have all rights, permissions, and consents needed for your User Content and its intended use. Do not submit confidential information you are not authorized to disclose.

7. Community Conduct

You must not use Neyli to create, upload, encourage, or distribute content or behavior that:

• is unlawful, fraudulent, deceptive, threatening, harassing, hateful, exploitative, or invasive of another person's privacy;
• sexualizes minors, depicts child sexual abuse, facilitates grooming, or endangers a child;
• promotes violence, self-harm, dangerous acts, terrorism, or criminal activity;
• contains unwanted sexual content, non-consensual intimate material, or sexual exploitation;
• infringes copyright, trademark, publicity, privacy, contract, or other rights;
• impersonates another person or misrepresents authorship, ownership, affiliation, or source rights;
• contains malware, automated abuse, spam, scraping, unauthorized advertising, or attempts to disrupt Neyli;
• circumvents reports, blocks, purchase verification, signed-wallpaper access, or other safeguards.

8. Wallpaper and Creator Rights

Neyli and its licensors retain all rights in the application, branding, interface, software, original signed wallpapers, and other Neyli materials. Wallpaper credits, ownership labels, and source terms shown with a work remain part of the permitted use.

Unless a work states broader rights, a wallpaper download is licensed for personal, non-commercial use as a device background. You may not resell, sublicense, remove attribution required by a source license, claim authorship, create a competing collection, or use a work in merchandise, advertising, training data, or commercial distribution without permission from the rights holder.

To report copyright or other rights infringement, email neyliteam@outlook.com with your contact information, identification of the protected work, identification of the material at issue, a good-faith explanation, a statement that the information is accurate and you are authorized to act, and your physical or electronic signature.

9. Reports, Blocks, and Enforcement

Neyli provides controls to block creators and report unclear rights, unwanted content, or other concerns. Reports should be accurate and submitted in good faith. Blocking affects your Neyli experience but does not create a legal finding about another person.

Neyli Team may review content and conduct, limit visibility, remove content, restrict features, preserve relevant records, suspend access, or refer a matter to an appropriate authority when reasonably necessary to enforce these Terms, protect users or rights, or comply with law. Enforcement may consider context, severity, recurrence, and risk. You may request review of an enforcement decision by emailing neyliteam@outlook.com.

10. Third-Party Services

Neyli may interact with Apple, Google, Microsoft email services, source-rights pages, and applications or people selected through the system share interface. Third-party services are governed by their own terms and privacy policies. Neyli Team does not control and is not responsible for third-party content, availability, security, purchases, or data handling.

You must comply with applicable third-party terms when using Neyli, including your wireless-data agreement and Apple Media Services terms.

11. Suspension, Account Deletion, and Survival

You may stop using Neyli at any time and may delete the active Neyli identity through account settings. Deletion removes that identity's app records and app-managed media from the device. It does not remove files previously shared to another destination or transaction records controlled by Apple.

Neyli Team may suspend or terminate access when you materially or repeatedly violate these Terms, create legal or safety risk, misuse purchases, infringe rights, or when required by law. Where appropriate, Neyli Team may provide notice and an opportunity to appeal.

Provisions concerning ownership, User Content already shared at your direction, purchase records, disclaimers, liability, disputes, and Apple beneficiary rights survive termination to the extent necessary to fulfill their purpose.

12. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, Neyli is provided “as is” and “as available.” Neyli Team disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and error-free operation. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.

Neyli provides creative and mood-oriented features, not medical, mental-health, legal, or financial advice. Do not rely on Neyli for emergency support or professional diagnosis or treatment.

To the maximum extent permitted by law, Neyli Team is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, goodwill, or opportunity; third-party conduct; or unauthorized use caused by failure to protect a device or account. Where liability cannot be excluded, Neyli Team's aggregate liability arising from Neyli will not exceed the greater of the amount you paid through Neyli during the twelve months before the claim or fifty U.S. dollars. This limitation does not apply where prohibited by law.

14. Applicable Law and Disputes

These Terms are governed by the laws that apply to your relationship with Neyli Team, without overriding mandatory consumer protections available where you reside. Before filing a formal claim, you and Neyli Team agree to make a good-faith effort to resolve the matter by email. Send a written description of the issue and requested resolution to neyliteam@outlook.com.

If the matter is not resolved, either party may bring it before a court or consumer-dispute body with jurisdiction under applicable law. Nothing in these Terms prevents either party from seeking urgent relief for security, misuse, or intellectual-property infringement.
